Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of myHVAC ("Service"), operated by myHVAC ("we," "us," or "our") at myhvac.app. By accessing our website, submitting our contact form, or using the myHVAC widget, you agree to be bound by these Terms. If you do not agree, do not use the Service.

What myHVAC Is

myHVAC is an AI-powered chat widget designed for HVAC contractors. It is embedded on a contractor's website and allows homeowners to ask HVAC-related questions and receive automated responses. When a homeowner provides contact information, that lead is forwarded to the contractor.

myHVAC is a software service. We are not an HVAC company, and we do not provide HVAC services, diagnoses, or professional advice.

AI Disclaimer (Important)

The myHVAC widget uses artificial intelligence to generate responses to homeowner questions. These responses are informational only and do not constitute professional HVAC advice, diagnosis, or a recommendation to take any specific action. AI responses may be inaccurate, incomplete, or not applicable to a specific situation. Always consult a licensed HVAC professional before making decisions about your heating or cooling system.

Contractors who deploy the myHVAC widget are responsible for ensuring that the AI's responses are appropriate for their customers and compliant with any applicable regulations in their jurisdiction.

Fees and Payment

myHVAC may offer free trial periods, after which a subscription fee applies. Pricing will be communicated to you directly before any charge is made. We reserve the right to change pricing with reasonable advance notice. Failure to pay may result in suspension or termination of your access.

Intellectual Property

All content, design, software, and technology comprising the myHVAC Service (including the widget code, branding, and platform) is owned by myHVAC and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the Service without our express written permission.

You retain ownership of any content or business information you provide to configure your widget (company name, branding, service area, etc.).

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate or suitable for any particular purpose. Your use of the Service is at your sole risk.

Limitation of Liability

To the fullest extent permitted by law, myHVAC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or your inability to use it. This includes damages arising from reliance on AI-generated responses by you or your customers.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the three months preceding the claim.

Termination

Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate your access to myHVAC immediately if you violate these Terms or engage in conduct we reasonably determine to be harmful to the Service, other users, or third parties. Upon termination, your widget will be deactivated and your data handled per our Privacy Policy.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Massachusetts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above. Continued use of myHVAC after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify active Contractors of material changes.
